§ 11.7. Protest.

  • In the event of a protest against such district change or amendment to the regulations of this ordinance, duly signed and acknowledged by the owners of 20 percent or more either of the area of the land included in such proposed change, or by the owners of 20 percent or more of the land immediately adjacent extending 100 feet therefrom, or by the owners of 20 percent or more of the land directly opposite thereto extending 100 feet from the street frontage of such opposite land, such changes or amendments shall not become effective except by the favorable vote of three-fourths of the full village board membership.

The above section conflicts with 65 ILCS 5/11-13-14 in that the 100-foot rule is not in the statute, instead protests may be made by "owners of 20 percent of the frontage proposed to be altered, or by the owners of 20 percent of the frontage immediately adjoining or across an alley therefrom, or by the owners of the 20 percent of the frontage directly opposite the frontage proposed to be altered."
