§ 10-11. Rules.

  • (a)

    The following rules shall be observed by owners of lots and visitors in the village cemetery:

    (1)

    No person shall ride or drive any horse or vehicle outside the limits of any lane, avenue or street.

    (2)

    No person shall ride or drive any horse or vehicle within the cemetery at a rate of speed faster than a walk, and no horse or vehicle shall be left by the driver thereof unless secured.

    (3)

    No person shall go upon any avenue, street, lane, alley, walk or public grounds within the cemetery to disturb, dig up, remove or carry away any turf, tree, shrub, earth or other material without authority from the cemetery committee or the board of trustees to do so.

    (4)

    No person shall go upon any lot to dig up, disturb, remove or carry away any turf, tree, shrub, earth or other material without authority from the owner to do so.

    (5)

    No person, other than by authority from the owner, shall go upon any improved lot to tramp upon the same or upon any grave.

    (6)

    No person shall molest, disturb, injure, destroy, mark or deface any fence, railing, seat, bower, monument, tombstone, stake, ornamental tree, shrub, plant or flower, or any property whatsoever, public or private, within the cemetery, unless by direction of the board of trustees or by authority from the owner to do so.

    (7)

    No person shall sport with or discharge any firearms within the cemetery unless authorized under the sanction of some public or burial ceremony.

    (8)

    No person shall occasion any nuisance or be guilty of any indecent or disorderly conduct within the cemetery.

    (9)

    All trees and saplings of any description, exceeding three inches in diameter, other than such which have been transplanted by owners of lots, are hereby declared to be the property of the village, and no owner of any lot or other person shall injure or remove any of the same without permission of the board of trustees to do so.

    (10)

    The owner of any lot shall have access to the cemetery with wagons, carts or teams, subject to the rules contained in this section, for the purpose of carrying in and depositing upon or removing from such lot materials for improving and ornamenting the same; and the right of visiting the cemetery at all reasonable hours and times shall be a public right to all persons conforming to the rules contained in this section.

    (11)

    Nothing shall be planted on any lot. Cut flowers and other small plants may be placed on any lot, as long as they are in a suitable container or planter. Containers shall be of unbreakable material. Such cut flowers or plants along with their containers shall be movable. The cemetery committee reserves the right to direct the removal of such flowers or plants, or such parts thereof, as are deemed detrimental, unsightly or inconvenient.

    (12)

    No lot shall be filled above the natural surface except by order of the board of trustees.

    (13)

    Foundations for all monuments, headstones, etc., shall be constructed in a substantial manner and to the satisfaction of the cemetery committee, and the person putting in such foundation shall promptly remove all earth and rubbish occasioned or accumulated thereby.

    (14)

    Any person disturbing the quiet and good order of the cemetery by noise or other improper conduct, or who shall violate any of the rules set forth in this subsection (a), will be compelled to leave the grounds.

    (b)

    Any person who shall violate any of the rules contained in this section shall, on conviction thereof, be fined as provided in section 1-9. All fines recovered for violation of this chapter or of such rules shall be paid into and become a part of the village cemetery fund.
